By accessing and using Surviving or Thriving? (“the Tool”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Tool.

2. Description of Service

Surviving or Thriving? is a self-assessment tool designed to help professionals from the global majority evaluate their workplace experience. It provides personalised insights, recommendations, and progress tracking. The Tool is offered free of charge.

3. Not Professional Advice

Important: The Tool is a reflective and diagnostic aid, not a substitute for professional counselling, therapy, legal advice, or medical treatment. The scores, patterns, and recommendations provided are based on self-reported data and algorithmic analysis. They are intended to support self-awareness and informed decision-making, not to diagnose conditions or prescribe specific actions.

If you are experiencing workplace harm, discrimination, or mental health difficulties, we strongly encourage you to seek support from qualified professionals.

4. User Accounts

When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorised access

5. Acceptable Use

You agree not to:

  • Use the Tool for any unlawful purpose
  • Attempt to access other users’ data or accounts
  • Interfere with or disrupt the Tool’s functionality
  • Use automated systems to access the Tool without permission
  • Misrepresent assessment results as clinical or legal findings

6. Intellectual Property

All content, including assessment questions, recommendations, techniques, pattern definitions, and the analytical framework, is the intellectual property of Surviving or Thriving? and its creators. You may not reproduce, distribute, or commercially exploit this content without written permission.

7. Exit Signalling & Sensitive Content

The Tool may surface exit signals or recommendations suggesting that your current workplace environment may not be sustainable. These signals are generated algorithmically based on your self-reported scores and are intended as prompts for reflection, not directives. Any decisions about your career or employment are solely your responsibility.

8. Limitation of Liability

The Tool is provided “as is” without warranties of any kind. We are not liable for any decisions made based on assessment results, recommendations, or exit signals. We are not responsible for any direct, indirect, incidental, or consequential damages arising from your use of the Tool.

9. Termination

We reserve the right to suspend or terminate access to the Tool at any time, with or without notice, for conduct that we believe violates these terms or is harmful to other users.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Tool after changes are posted constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith discussion in the first instance.
